Rezoning Process

Properties within the City of DeWitt can be rezoned under certain circumstances - the rezoning fits the comprehensive plan, the rezoning does not negatively impact adjacent property owners, and the rezoning is approved by the Planning and Zoning Commission and the City Council. Rezoning a property in the City requires an amendment to the City's ordinances. Below is a brief summary of the rezoning process and the approximate length of time that it takes to accomplish rezoning a property.

The Rezoning Process

• Discuss rezoning with City Administrator and pick up or download rezoning request form

• Request rezoning at least 2 weeks before next Planning and Zoning Commission Meeting (P&Z meet every 2nd Tuesday of each month)

• The City will publish a public notice for public hearing in the Observer describing the proposed rezoning at least 7 and no more than 20 days before the scheduled hearing

• The P&Z Commission will hold a public hearing for the rezoning request at the same meeting the P&Z will approve or disapprove the rezoning and make a recommendation to the City Council

• If approved by the P&Z the City must again publish notice of a public hearing (at least 7 and no more than 20 days before the scheduled hearing) to be held by the City Council on the proposed rezoning.

• The first City Council meeting of the next month (City Council meets every 1st and 3rd Monday) the City Council will hold a public hearing on the proposed rezoning.

• At the same meeting the Council will consider the first of 3rd readings of the ordinance that will put into effect the rezoning.

• Two weeks later at the next City Council meeting the Council will consider and vote on the 2nd reading of the new zoning ordinance.

• A request can be made to waive the 2nd and 3rd readings of the new zoning ordinance, however the Council does not waive readings very often.

• The first City Council meeting of the next month the City Council will consider and vote on the 3rd and final reading of the proposed new zoning ordinance.

• If approved the ordinance becomes effective when published in the DeWitt Observer, generally the next Saturday after the Council meeting.

• The process generally will take at least 2 months and sometimes 3 months depending on the exact dates of meetings.
